A legally binding advance healthcare directive must be drawn up in writing, dated, and executed in the presence of a solicitor (ÖRAK), a notary (ÖNK) or a legally qualified member of staff at the Patient Advocacy Service.

The power of attorney can only be given to a notary, a lawyer or, in simple cases, to an adult protection organisation (if there is sufficient capacity). It must be in writing. Another requirement for giving a power of attorney is that you must have legal capacity.
